MINUTES OF THE PRESIDENCY OFFICE MEETING

The Presidency Office of the Friuli Venezia Giulia/Veneto/South-Western Croatia CGIL, CISL, UIL, SSSH Interregional Trade Union Council met on 19th June 2009 in Trieste, at the headquarters in via Polonio 5.

Attending members: Luca Visentini (UIL Friuli Venezia Giulia), Emilio Viafora (CGIL Veneto), Natasa Ciabatti (CGIL Friuli Venezia Giulia, replacing Roberto Treu), Jadranka Tomašić (SSSH South-Western Croatia), Slobodan Kapor (SSSH South-Western Croatia) and Ivica Perinić (SSSH South-Western Croatia).

Absent without leave: Elvio Di Lucente (CISL Friuli Venezia Giulia) and Josip Šišović (SSSH South-Western Croatia).

Other attending person: Michele Berti (UIL Friuli Venezia Giulia), as minute-taker.

At 11.13, Luca Visentini, acting as President, opened and chaired the meeting of the Presidency Office.

1. As decided in the General Assembly meeting held on 10th December 2008, the following activities have been suggested for the year 2009:

  • a comparison between collective bargaining in the tourism sector in Italy and in Croatia with a survey and a workshop at the end of the activity to be held within the end of the year. As for this survey, besides comparing the two national collective agreements, a proposal was put made to identify a hotel chain, possibly owned by an Italian company, with hotels in both countries and with integrative corporate agreements or a second level agreements. Colleagues from SSSH South-Western Croatia were asked to identify both, the hotel chain and a candidate researcher to appoint for the survey. The IR.T.U.C. Presidency Office unanimously approved the proposal;
  • feasibility study on an international agreement on frontier work between Italy and Croatia aimed at supporting this particula kind of employment, in particular on 4 critical points concerning the status of frontier workers, as a cause for discrimination, namely a) regulations on immigration, b) provision of social security benefits, c) risk of double taxation on the income from subordinate employment, d) actual acknowledgement of rights in compliance with international conventions, such as the option to choose the jurisdiction in case of labour disputes and the option to choose the applicable national law to the employment contracts. This activity was extremely topical, considering that on 29th May 2009 the Italian Parliament adopted the agreement aimed at avoiding double taxation on income between Italy and Croatia (signed in Rome on 29th October 1999 which will soon replace the agreement signed in 1982 between Italy and Jugoslavia now in force, as Croatia had become part of it after its independence), which unfortunately does not cover cross-border employment. This may be remedied by adding a protocol on frontier work after the entry into force. Moreover, everyone agree about the fact that point d) must be carefully reviewed. The IR.T.U.C. Presidency Office unanimously approved the proposal;
  • identification by the colleagues of SSSH South-Western Croatia of branches of Italian companies located in Croatia, whose internal trade union representation may benefit from a support from Italian colleagues working in the branches of the same company located in Italy, concerning negotiation on corporate agreements. The IR.T.U.C. Presidency Office unanimously approved the proposal;
  • realization, but only if E.T.U.C. provided the financing for a specific project involving IR.T.U.C.s (as in 2008 and as suggested by Walter Cerfeda in the workshop held in Umag on 10th December 2008), of a comparative survey/study on the legislation on employment in Italy and in Croatia, in particular on the changes introduced by Croatia with a view to transposing the acquis communautaire. The IR.T.U.C. Presidency Office unanimously adopted the proposal.

2. Participants were reminded that members of IR.T.U.C. bodies must be appointed in the next General Assembly meeting. Therefore, candidates replacing current members must be identified within the date of the General Assembly, in case current members needed to be replaced.

As no requests to take the floor were made, Luca Visentini officially closed the meeting of the IR.T.U.C. Presidency Office at 12.34.
